Default Re: Bellavegas won't pay 20K in winnings

I'm going to break my self imposed ban here since this involves two things I care about in the industry.
One, a decent casino group, and two, what appears to be a reasonably honest player.

This can be beat up lots of different ways, but the simple fact is both sides are a little wrong.
It's been quite a while since I've seen a cut and dry case of the "Casino was 100% right", or where the "Player was 100% right". There is usally some fault on both sides, and this one is no different.
The players demand that the casinos live up to the letter of the terms when it benefits them, so it's not unreasonable for the casinos to do the same when it works to their advantage.

The casino's only mistake was not catching the age problem on the very first payout.
Had they caught it at that time, this thread would not be justified.
The problem, they didn't catch, and in fact didn't catch it several times.
That was wrong, and by paying out several times, that does establish a contract so to speak, or acceptance of the player legitimacy.

The player knows that his age can be, and has been problematic, and he clearly didn't read the terms closely enough. He is at fault too.

Once there is an infraction on both sides, there is no attributing, or assessing percentages of "FAULT".
{IE: this side is 25% wrong, and this side is 75% wrong.}
There is only one place to meet, and that is in the middle.
Both sides in a gambling situation should accept the monetary RISK they took equally.

I see the problem being addressed here, but no solutions are being offered, so let me propose one.

Add up the players TOTAL winnings. Divide it by 2.
Add up the players TOTAL deposits, Divide it by 2.
{Yes, the deposits. He should share the risk of his potential loss equally too}
Subtract 50% of the deposits, from the 50% of the winnings.

Subtract from that number whatever the amount is that he has already been paid, and pay the difference.
That's fair to both sides, IMO.
I don't have the time right now to go thru all this to get the numbers but if someone knows all of them, do the math, and suggest it to the casino.
Who knows? They might be OK with that.
There is no perfect solution.
When things like this occur, it just comes down to finding a fair solution to BOTH the player, and the casino.

Ok. Hope that was contructive, and helps out in some way.
Back into seclusion now! :-)
